Infinityy (“Company”, “we”, “us”, or “our”) provides an immersive, AI-powered platform for real estate professionals and home buyers, to tour homes and explore neighborhoods virtually, anytime, from anywhere. This Privacy Policy describes how we handle personal information when you create an account, access, or use our application and related services (the “Platform”). This Policy applies to personal information that we collect from (1) our business customers, including real estate associations, agents, brokers, and MLS partners (“Business Customers”), and (2) individuals who use the Platform to view properties, participate in virtual tours, or otherwise engage with listings (“Consumers”).

This Privacy Policy does not apply to personal information that we process on behalf of our Business Customers in our capacity as a data processor or service provider. When we process personal information on behalf of a Business Customer (such as consumer lead information, inquiries, and interactions submitted in connection with a Business Customer’s listings), the Business Customer’s own privacy policy governs the collection and use of that information. If you have questions about how a Business Customer handles your personal information, please contact that Business Customer directly.

Personal information we collect

Information we collect from Business Customers. We collect personal information from our Business Customers who utilize the Platform to market their business and support sales. This information may include:

  • Business Contact Information. Such as first and last name, the name of the organization or entity you represent, email address, business address, or business phone number.
  • Product preferences, such as your preferred in-product settings or account-specific configurations.
  • Feedback or correspondence, such as information you provide when you contact us with questions, feedback, or otherwise correspond with us online.
  • Photographs and Images: including profile pictures and any images you upload. You may also choose to allow the Service to access photos on your device’s camera roll by explicitly granting permission to certain products and features.
  • Marketing information, such as your preferences for receiving our communications, and details about how you engage with our communications.
  • Account credentials and authentication data, such as your username, password, and other information used to authenticate your access to the Platform, including single sign-on tokens and multi-factor authentication details.
  • Billing and account management information, such as billing name, billing address, payment method details, transaction history, subscription plan, and related account administration records.
  • Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Information we collect from Consumers. We collect personal information from Consumers and other end users who use the Platform to connect with Business Customers and view and tour places virtually. This information may include:

  • Contact information, such as your first and last name, email address, and, if you choose to provide it, your phone number.
  • Photographs and Images: including profile pictures and any images you upload. You may also choose to allow the Platform to access photos on your device’s camera roll by explicitly granting permission to certain products and features.
  • Product usage information, such as information relating to how you use the Platform, including your engagement with virtual tours, property listings, AI-driven features, and other Platform functionality, as well as frequency of use, navigation behavior, and other similar interaction data.
  • Location Information. We derive general location information (such as city, state, or geographic area) from your IP address. We may collect precise location information (such as GPS data) to enable features such as searching for nearby properties or other location-based functionality, in which case we will provide appropriate notice and obtain your consent.
  • Feedback or correspondence, such as information you provide when you contact us with questions, feedback, or otherwise correspond with us online. This also includes records of communications sent through the Platform, including notifications and messages between consumers and business customers.
  • Communications in shared experiences. If you participate in shared virtual tour environments (such as collaborative viewing rooms), information you share with other participants during those sessions may be visible to other users in the same session.
  • Marketing information, such as your preferences for receiving our communications, and details about how you engage with our communications.
  • Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Information we obtain from third parties. When you log in to the Platform using a third-party service such as Google, we may receive your name and email address from that service. We may also receive professional contact information for Business Customers from publicly available sources, MLS partners, or industry lists to support outreach and onboarding efforts. In addition, we may receive property-related content, including listing data and images, from MLS partners and other authorized sources pursuant to contractual agreements. We may also maintain pages on social media platforms, such as LinkedIn, and other third-party platforms. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use, and processing of your personal information.

Automatic data collection. We and our service providers may automatically log information about you, your computer or mobile device, and your interactions over time with the Platform, our communications, and other online services, such as:

  • Device data,such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers, language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 5G), and general location information such as city, state or geographic area.
  • Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, browsing history, navigation paths between pages or screens, information about your activity on a page or screen, access times, duration of access, and whether you have opened our marketing emails or clicked links within them.

We use the following tools for automatic data collection:

  • Cookies, which are text files stored on a visitor‘s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, and enabling functionality. We use Google Analytics to collect information about how users use the Platform, which we then use to compile reports that disclose trends without identifying individual visitors and help us improve the Platform.   • Local storage technologies, like HTML5, provide cookie-equivalent functionality but can store larger amounts of data, including on your device outside of your browser in connection with specific applications.
  • Web beacons, also known as pixel tags or clear GIFs, are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.

How we use your personal information

  • To provide, operate, maintain, and secure our Platform, including providing virtual tours, listings, and related features, facilitating communication and lead generation between Consumers and Business Customers, and delivering notifications and responding to user inquiries.
  • To communicate with you, including to respond to your requests, provide support, and otherwise communicate with you about our services, including by sending announcements, surveys, updates, security alerts, and support and administrative messages.
  • Improve, monitor, and personalize the Platform, including by understanding your needs and interests, and personalizing your experience with the Platform and our communications.
  • For research and development. We may use your personal information for research and development purposes, including to analyze and improve our services and our business. As part of these activities, we may create aggregated, de-identified, or other anonymous data from personal information we collect. We may use this data and disclose it to third parties for our lawful business purposes, including to analyze and improve our services and promote our business.
  • AI-powered features. The Platform includes AI-driven features, including chatbot and virtual assistant functionality. When you interact with these features, your inputs (including questions, messages, and prompts) may be processed by our third-party AI service providers to generate responses. We may use data from your interactions with AI features, including personal information, to develop, train, and improve AI models and functionality, whether operated by us or our partners. We may share personal information collected through AI features with third-party service providers, Business Customers, and other third parties, who may use such information for their own business purposes. Your interactions with AI features, including chat content, may be shared with the relevant Business Customer as part of the Platform’s core lead generation and communication functionality.
  • Direct marketing. We may send direct marketing communications to you as permitted by law. For Business Customers, this may include emails regarding Platform availability, product updates, new features, and educational opportunities. For Consumers who have created an account, this may include emails and SMS messages with updates on properties marketed within the Platform and other relevant offerings. You may opt out of marketing communications as described in the “Opt out of marketing communications” section below.
  • Interest-based advertising. We and our advertising partners, including third-party advertising companies, social media companies, and other third-party advertisers (such as insurance providers, mortgage lenders, and financial services firms), may display advertisements to you within the Platform and across the web. These partners may use cookies and similar technologies to collect information about your interaction over time across our website, our communications, and other online services, and use that information to serve online ads that they think will interest you. In addition, we may use information about your activity on the Platform, including the types of properties you view, price ranges, geographic areas, and other engagement data, to create audience segments and enable third-party advertisers to deliver targeted advertisements to you within the Platform. We may also share information about our users with these companies to facilitate interest-based advertising to those or similar users on other online platforms.   • Compliance and protection. We may use personal information to:
    • Comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities.
    • Protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims).
    • Audit our internal processes for compliance with legal and contractual requirements and internal policies.
    • Enforce the terms and conditions that govern the Platform.
    • Prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

How we disclose your personal information

  • Business Customers. We may disclose, sell or share personal information of Consumers to Business Customers and other third parties in connection with the Platform’s core functionality, including lead information, consumer inquiries and messages, interactions with listings and virtual tours, chat content, and engagement analytics related to listing performance.
  • Affiliates. We may disclose your personal information to our subsidiaries and affiliates, for purposes consistent with this Privacy Policy.
  • Service providers. We may disclose your personal information to third-party companies and individuals that provide services on our behalf or help us operate the Platform, such as cloud hosting and infrastructure, AI and machine learning services, SMS and communications services, mapping and geolocation services, analytics, payment processing, customer support, email delivery, marketing, and database management services.
  • Advertising and marketing partners. We may disclose personal information, including information about your activity on the Platform, property viewing behavior, audience segment data, and other engagement information, to third-party advertising and marketing partners, including insurance providers, mortgage lenders, financial services firms, and other advertisers, to enable them to deliver targeted advertisements to you within the Platform or elsewhere. Such disclosures may involve the sale or sharing of personal information, as described further in the “Do Not Sell or Share My Personal Information” section below.
  • Authorities and others. We may disclose your personal information to law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.
  • Business transfers. We may sell, transfer or otherwise share some or all of our business or assets, including your personal information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution. In such a case, we will make reasonable efforts to require the recipient to honor this Privacy Policy.

International Data Transfers. You will provide personal information directly to us in the United States. We may also transfer personal information to our affiliates and service providers in the United States and other jurisdictions. Please note that such jurisdictions may not provide the same protections as the data protection laws in your home country.

When we engage in cross-border data transfers, we will ensure that relevant safeguards are in place to afford adequate protection for personal information and we will comply with applicable data protection laws, in particular by relying on contractual protections for the transfer of personal information. Your choices

  • Opt out of marketing communications. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email. If you receive SMS marketing messages from us, you may opt out by replying STOP to any such message or by contacting us as described in the “How to Contact Us” section below. You may continue to receive service-related and other non-marketing communications.
  • Personal information requests. We offer you choices that affect how we handle your personal information. Depending on your location and the nature of your interactions with our Services, you may request the following in relation to personal information. Your authorized agent may also submit requests on your behalf in the same manner. Once we receive your request, we will verify your identity by sending an email to the email address you provide to us.
  • Information about how we have collected and used personal information. We have made this information available to you without having to request it by including it in this Privacy Policy.
  • Access to a copy of the personal information that we have collected about you. Where applicable, we will provide the information in a portable, machine-readable, readily usable format.
  • Correction of personal information that is inaccurate or out of date.
  • Deletion of personal information that we no longer need.
  • Appeal our denial of your personal information request by contacting us as set out in the “How to Contact Us” section below.
  • Where we rely on your consent, you may withdraw your consent at any time.

To make a request, please email us or write to us as provided in the “How to Contact Us” section below. We may ask for specific information from you to help us confirm your identity. You are entitled to exercise the rights described above free from discrimination.

Please note that where we process your personal information on behalf of a Business Customer as a data processor, you should direct your privacy rights requests to the relevant Business Customer. We will assist the Business Customer in responding to such requests as required by applicable law and our agreements with the Business Customer.

Limit online tracking. There are a number of ways to limit online tracking, which we have summarized below. Please note that these tools are not associated with us and we cannot guarantee that they work as their providers advertise them:

  • Blocking cookies in your browser. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. For more information about cookies, including how to see what cookies have been set on your device and how to manage and delete them, visit https://www.allaboutcookies.org/.
  • Using privacy plug-ins or browsers. You can block our websites from setting cookies by using a browser with privacy features, like Brave, or installing browser plugins like Privacy Badger, Ghostery, or uBlock Origin, and configuring them to block third party cookies/trackers.   • Blocking advertising ID use in your mobile settings. Your mobile device settings may provide functionality to limit use of the advertising ID associated with your mobile device for interest-based advertising purposes.

Note that because these opt-out mechanisms are specific to the device or browser on which they are exercised, you will need to opt out on every browser and device that you use.

Do Not Sell or Share My Personal Information. Under the California Consumer Privacy Act (“CCPA”), California residents have the right to opt out of the “sale” or “sharing” of their personal information. As described in this Privacy Policy, we may disclose, sell, or share personal information to third parties, including Business Customers, advertising partners, and other third parties, in ways that may constitute a “sale” or “sharing” under the CCPA. California residents may exercise their right to opt out of such sales and sharing by submitting a request through our online “Do Not Sell or Share My Personal Information” form available, by contacting us as described in the “How to Contact Us” section below, or by broadcasting an opt-out preference signal such as Global Privacy Control, as described further below. We will process your opt-out request as required by applicable law. Please note that we do not knowingly sell or share the personal information of individuals under 16 years of age.

Global Privacy Control. We process opt-out preference signals sent via Global Privacy Control (“GPC”) as required by applicable state laws. To learn more about Global Privacy Control, please visit https://globalprivacycontrol.org/.

Other sites, mobile applications and services. The Platform may contain links to other websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages or in mobile applications or online services that are not associated with us. We do not control third-party websites, mobile applications, or online services, and we are not responsible for their actions. Other websites and services follow different rules regarding the collection, use, and disclosure of your personal information. We encourage you to read the privacy policies of the other websites, mobile applications, and online services you use.

Security. We employ a number of technical, organizational, and physical safeguards designed to protect the personal information we collect. However, no security measures are failsafe, and we cannot guarantee the security of your personal information.

Data Retention. We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements. Business Customer account data is retained for the duration of the customer relationship and for a reasonable period thereafter as required for account management, legal, and operational purposes. Consumer lead and interaction data is retained for as long as necessary to facilitate communication between Consumers and Business Customers and to support Platform functionality and analytics. Interaction and usage data, including virtual tour and AI interactions, is retained for a limited period to support analytics, product improvement, and system performance, after which it may be deleted or de-identified. Technical and log data is retained for a short period for security, monitoring, and debugging purposes, unless longer retention is required in connection with investigations or legal obligations.

Children. The Platform is not intended for use by children under 13 years of age. If we learn that we have collected personal information through the Platform from a child under 13 without the consent of the child’s parent or guardian as required by law, we will delete it.

Changes to this Privacy Policy. We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Platform or otherwise providing notice to you.
